Terms of Service
Draft revised: October 18, 2026
Effective date: To be confirmed upon publication
Publication note (remove before publishing): This draft is adapted for a private jet charter brokerage and a Wix-hosted informational website. It is not a substitute for a lawyer's review. Confirm Altura's legal entity name, contact details, charter contracting and payment practices, applicable jurisdiction, and whether the website uses member accounts or SMS marketing. The original template's California arbitration clause, class-action waiver, California mailing addresses, membership offerings, app-store billing, and unsupported SMS commitments have not been carried forward.
1. Agreement to These Terms
Welcome to ALTURA JETS LLC ("Altura Jets," "Altura," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our website at https://www.flyalturajets.com/ and the online content, contact forms, charter inquiry features, and related services we make available (collectively, the "Website Services"). By using the Website Services, you agree to these Terms. If you do not agree, please do not use the Website Services.
Our Privacy Policy describes our handling of personal information. Verify the Privacy Policy URL before publication.Specific charter quotes, booking confirmations, agreements, and terms provided by an aircraft operator or other service provider may apply separately to a particular transaction. If there is a conflict, the transaction-specific terms govern that transaction to the extent of the conflict.
2. Our Role as a Charter Broker
IMPORTANT BROKER DISCLOSURE: ALTURA JETS LLC IS AN AIR CHARTER BROKER, NOT A DIRECT AIR CARRIER OR AIRCRAFT OPERATOR. ALTURA JETS DOES NOT OWN, OPERATE, OR EXERCISE OPERATIONAL CONTROL OVER AIRCRAFT USED FOR CHARTER FLIGHTS. ALL CHARTER FLIGHTS ARE PERFORMED BY INDEPENDENT, THIRD-PARTY AIR CARRIERS THAT RETAIN OPERATIONAL CONTROL AND ARE RESPONSIBLE FOR THE SAFE OPERATION OF THEIR FLIGHTS.
Altura assists clients in requesting, comparing, coordinating, and arranging private charter transportation with third-party operators. Aircraft availability, aircraft type, itinerary, schedules, amenities, and quoted pricing are subject to confirmation. Any descriptions of aircraft, services, or operator qualifications on our website are informational and do not guarantee a particular aircraft or service.
The operating air carrier, not Altura, is responsible for flight operations, aircraft maintenance, crew qualifications, dispatch decisions, and regulatory compliance associated with operating the flight. Altura remains responsible for its own conduct and obligations as a broker to the extent required by applicable law. Nothing in these Terms is intended to waive non-waivable passenger rights or regulatory obligations.
3. Charter Requests, Quotes, and Bookings
Submitting an inquiry or receiving an estimate does not constitute a confirmed reservation. Charter arrangements are confirmed only when the applicable parties accept the relevant booking documents and any required payments or deposits have been completed in accordance with those documents.
Quotes may change due to availability, routing, airport and handling charges, fuel, taxes, weather, repositioning, or other operational factors. Before accepting a booking, review the written quote and any applicable operator or charter agreement carefully, including cancellation, refund, baggage, pet, identification, and passenger requirements. Altura will identify the applicable contracting parties and terms as part of the booking process.
We may coordinate ancillary services, such as ground transportation or catering, where available. Such services may be performed by independent third parties and may be subject to separate terms.
4. Payments, Cancellations, and Refunds
Payment instructions, payment recipients, due dates, fees, cancellation charges, and refund eligibility will be stated in the applicable quote, invoice, or booking agreement. These Terms do not establish a universal cancellation or refund policy for every charter.
Do not send payment based solely on unsolicited or unverified instructions. Contact Altura using the details below to confirm any unexpected change to payment instructions. Any payment processing by third parties is subject to their applicable terms and privacy practices.
5. Eligibility and Acceptable Use
You must be legally capable of entering into binding agreements to make a charter booking. If you act on behalf of an organization, you represent that you are authorized to bind that organization.
You agree not to use the Website Services to violate laws, misrepresent your identity, infringe intellectual property rights, interfere with the website's security or operation, introduce malicious code, harvest personal information without authorization, or use automated scraping tools in a manner that disrupts the Website Services.
We may restrict access to the Website Services where reasonably necessary to protect users, the website, or our legal rights.
6. Information You Submit
When you submit an inquiry, itinerary, passenger details, preferences, or other information, you represent that the information is accurate to the best of your knowledge and that you are authorized to share it. You remain responsible for obtaining required travel documents and complying with applicable travel and entry requirements.
We may use submitted information to respond to requests, coordinate with relevant charter operators and service providers, and administer requested services, subject to our Privacy Policy and applicable law. Please do not send payment-card details or sensitive identification documents through an unsecured general inquiry form unless we expressly direct you to an appropriate secure process.
7. Website Content and Intellectual Property
Unless otherwise indicated, our website design, text, branding, graphics, and other original content are owned by Altura or used with permission and are protected by applicable intellectual property laws. You may view the website for personal or legitimate business inquiry purposes but may not reproduce, distribute, or commercially exploit our protected content without permission, except as allowed by law.
Any third-party names, trademarks, aircraft imagery, or operator information remain the property of their respective owners. Their appearance does not necessarily indicate endorsement or affiliation.
8. Third-Party Websites and Services
Our website may link to websites or services operated by aircraft operators, payment processors, Wix, or other third parties. We do not control those sites and are not responsible for their independent content or practices. Review their terms and privacy policies before using them.
9. Website Availability and Information Accuracy
We seek to provide useful and accurate information, but the Website Services and their content are provided on an "as available" and "as is" basis to the extent permitted by law. Website content may contain errors or become outdated. We do not guarantee uninterrupted website access, error-free functionality, or the availability of any particular charter flight.
Nothing in this section disclaims duties or warranties that cannot legally be excluded, or changes specific commitments made in a confirmed written charter agreement.
10. Limitation of Liability
To the extent permitted by applicable law, Altura is not responsible for indirect, incidental, special, or consequential losses arising solely from your use of the informational Website Services, including interruptions or inaccuracies in general website content. This limitation does not apply where prohibited by law, including to liability that cannot be excluded for fraud, willful misconduct, gross negligence, or other non-waivable duties.
This section concerns the Website Services and does not replace or override liability provisions in a separately executed charter booking agreement or applicable passenger-protection law.
11. Privacy, Cookies, and Wix
Our website is built using Wix. Wix and any other service providers used to host, secure, operate, or analyze the website may process information as described in our Privacy Policy and their own applicable terms. The specific cookies and analytics technologies used depend on the settings and integrations actually enabled on our website. Please refer to our Privacy Policy and any cookie controls made available on the site.
12. Communications
If you contact us or request charter services, we may respond through the contact information you provide, including by phone or email. If we offer optional marketing text messages, we will provide any required consent disclosures and opt-out instructions at the point of enrollment. These Terms do not represent that Altura currently operates an SMS subscription or a membership program.
13. Changes to the Website Services and Terms
We may modify or discontinue website features and update these Terms from time to time. Updated Terms will be posted on our website with a revised effective date. Changes apply prospectively to website use after they take effect, except where otherwise agreed or required by law. Changes to a confirmed charter booking are governed by the relevant booking agreement.
14. Suspension or Termination of Website Access
You may stop using the Website Services at any time. We may suspend or limit access when reasonably necessary due to misuse, security concerns, or legal requirements. Sections that by their nature should survive termination, including intellectual property, limitations of liability, and dispute-related provisions, will continue to apply as permitted by law.
15. Applicable Law and Disputes
These Terms are subject to applicable United States federal law and other laws that govern the parties and transaction. Before filing a legal claim concerning the Website Services, we encourage you to contact us so we can attempt to resolve the issue informally. Nothing in this section limits rights or remedies that cannot be waived by contract.
Legal-review item: The original template required arbitration in Los Angeles County under California law. Those provisions were removed rather than automatically applying another company's dispute-resolution terms to Altura. Counsel should determine whether Altura should adopt a tailored governing-law, venue, arbitration, or class-action provision.
16. Miscellaneous
If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect to the extent legally permissible. Our failure to enforce a provision does not waive our right to enforce it later. These Terms govern use of the Website Services; separate written booking agreements govern their own subject matter. Nothing in these Terms creates a partnership, agency, employment, or joint venture between you and Altura.
